Le tableau ci-dessous énumère les personnes qui ont été reconnues coupables d’une infraction en vertu de la Loi sur les normes d’emploi et/ou de ses règlements au cours des mois indiqués ci-dessous. Il comprend les procès-verbaux et les assignations en vertu de la Partie I de la Loi sur les infractions provinciales et les poursuites en vertu de la Partie III de la Loi sur les infractions provinciales.
Les renseignements au sujet des condamnations en vertu de la Loi de 2000 sur les normes d'emploi sont affichés sur le site Web du ministère du Travail pendant une période d'un an à partir de la date d'affichage. Ils sont ensuite retirés du site.
Les informations au sujet des poursuites sont disponibles pour les mois suivants :
- Procès-verbaux en vertu de la Partie I de la Loi sur les infractions provinciales :
- À partir du 14 juillet 2004, les agents des normes d'emploi ont été autorisés à émettre des procès-verbaux aux employeurs qui ne se conforment pas aux exigences de certaines dispositions de la Loi sur les normes d'emploi et de ses règlements. Les procès-verbaux s'élèvent à 295 $ auxquels s'ajoutent les coûts additionnels usuels et les primes de surcharge pour les victimes.
- Assignations en vertu de la Partie I de la Loi sur les infractions provinciales :
- Une assignation en vertu de la Partie I de la Loi sur les infractions provinciales ordonne au défendeur de comparaître au tribunal à une heure, un lieu et une date donnés. Si le défendeur est reconnu coupable, le montant maximal d'une amende est de 1 000 $ par infraction.
- Poursuites en vertu de la Partie III de la Loi sur les infractions provinciales :
- Dans le cadre des poursuites en vertu de la Partie III, un particulier est passible d'une amende maximale de 50 000 $ et d'un emprisonnement maximal de 12 mois, sur déclaration de culpabilité. Une personne morale est passible d'une amende maximale de 100 000 $ pour une première condamnation, de 250 000 $ pour une deuxième condamnation, et de 500 000 pour toute condamnation subséquente.
